(hereinafter abbreviated: ASV)

 

1. Scope:

These General Terms and Conditions (GTC) apply to all ASV services, in particular to courses and workshops at all locations where these are carried out by ASV. By booking such a course unit, the customer accepts the following terms and conditions.

 

1. right of use
   a) With the acquisition of a registration for courses or workshops, the customer is entitled to use the premises of the ASV Studios during the offered course times. The customer is entitled to use the ASV premises for changing and showering 15 minutes before and 15 minutes after the end of the lessons/workshops.
   
   b) In principle, all services of the ASV Studio are open to the customer. However, there is no legal entitlement to the use of services. There is a limited number of participants for all lessons and workshops. If special personal conditions are required for certain services, these must be fulfilled by the customer. If these conditions are not met, there is no obligation for ASV to provide the service.
   
   c) The customer must always behave in the studio premises in such a way that there is no disruption to the course of the lessons/workshops, the equipment in the studio is treated with care and there is no impairment of the other participants comes. In the interest of all participants, the customer must follow the instructions of the employees of ASV. In the event of gross violations by the customer of these general terms and conditions and these corresponding instructions by ASV employees, such as physical assaults, threats, insults, sexual harassment, theft, poor hygiene, etc., access to the ASV Studio can be denied at the first Violation be denied without this leading to a refund obligation.

 

1. Terms of Payment and Withdrawal

When booking the course, payment is also made online. Course fees that have already been paid cannot be refunded. However, the participant has the right to nominate a substitute participant up to 48 hours before the start of the training. Such a rebooking is free of charge for the participant. Only partial participation in an event does not entitle you to a reduction in payment. Unless this has already been agreed when registering (e.g. if you join a course that is not fully booked).

 

1. changes

Aerial Silk Vienna reserves the right to change the location and/or date of an event or to cancel it for important reasons (e.g. insufficient number of participants). In case of cancellation, Aerial Silk Vienna will offer an alternative date or refund the course fee. The use of another trainer does not entitle you to a reduction in payment and/or cancellation.

 

1. Disclaimer

The customer is informed that there are no lockable lockers on the premises of ASV. Items brought along are left unattended in the changing room. Any valuables you bring with you are to be taken into the course room. Unless evidence is provided that ASV employees were involved, liability in the event of the loss of clothing, valuables or money brought along is excluded.

The use of ASV services is at your own risk and peril. ASV is not liable for accidents or resulting physical damage to customers. ASV is also not liable for the consequences of improperly performed exercises. In this regard, reference is made to point 6.

 

1. state of health of the customers

By registering for a course or workshop, every customer makes a binding declaration that they are physically healthy and mentally stable and are able to meet the relevant physical and mental requirements and will only participate if they are in such a state. Participation under the influence of drugs, alcohol or medication is not permitted. With his/her participation, the customer assures that he/she does not suffer from any contagious disease and that there are no medical reasons preventing the exercises to be carried out. If in doubt, consult a doctor. Chronic illnesses and other physical or mental ailments that could affect other participants or endanger them must be reported to the course leaders before the start of the lesson. In the event of pregnancy, the customer must obtain medical clearance before participating.

 

1. Privacy Policy

Customer data may be used for our own advertising purposes for the purpose of fulfilling the contract and will not be passed on to third parties. The customer agrees that his/her data will be stored in ASV's IT system for a maximum of 10 years after the last visit to the studio. All information will be treated confidentially in accordance with the applicable data protection regulations.

 

1. Jurisdiction, applicable law

The court responsible for 1010 Vienna is the exclusive place of jurisdiction.

 

1. Miscellaneous

There are no ancillary agreements to these General Terms and Conditions. Changes to these terms and conditions must be in writing, as must changes. Should individual clauses of these General Terms and Conditions be wholly or partially ineffective, this does not affect the effectiveness of the remaining clauses and the contract remains in effect, with the ineffective clause being replaced by a clause that comes as close as possible to the purpose of the ineffective clause in economic terms. The written form requirement is met by transmission as an email. If the customer has provided an email address, all messages between the contracting parties can be sent by email.
